Andy Chan is a lawyer and the founder of Agile Legal Solutions, a Richmond Hill firm practising estate planning and corporate law. He advises individuals and families on planning their estates, and owners of small and medium-sized businesses on their corporate matters.

Common Questions

The questions people ask most often about wills, estates and planning ahead in Ontario.

Do I need a will if I don't own much?

Yes, in most cases. A will names who looks after your children and who handles your estate, not only who receives your money. Without one, Ontario law decides those questions for your family.

What happens if I can't make my own decisions?

Ontario uses two documents for this: one for property, which covers money and investments, and one for personal care, which covers health and living decisions. Without them, a relative may have to apply to the court or the Office of the Public Guardian and Trustee before acting for you.

Does getting married cancel my will in Ontario?

Not anymore. Since January 2022, getting married in Ontario no longer cancels an existing will, and in some cases a spouse you have separated from is treated as if they died before you for gifts in your will. An older will may not say what you want today.

What is probate, and does every estate need it?

Probate is what most people in Ontario call the Certificate of Appointment of Estate Trustee. Banks and buyers often ask for it before releasing accounts or property. Estate Administration Tax is generally based on the value of the estate, and smaller estates can generally apply for a simpler small estate certificate.

I own a private company. Why would I need two wills?

Many Ontario business owners use two wills: one for assets that need probate, and a second for assets such as private company shares that usually do not. Whether that fits depends on what you own.

Can a trust protect a family member who receives ODSP?

A Henson trust can generally protect Ontario Disability Support Program eligibility for a beneficiary who receives those monthly payments. Trusts can also hold an inheritance for children until they reach an age you choose.

Can I sign my will by video?

Ontario generally allows wills to be witnessed by video when one witness is licensed by the Law Society of Ontario. Signing correctly matters as much as the wording, and we walk you through it.

What does the free consultation include?
